2. PURPOSE AND SCOPE OF APPLICATION
This Legal Notice governs access to and use of the web platform cybergune.eus, which is configured as the Cybergune virtual community (hereinafter, the Community).
The Community aims to foster collaboration and synergies among the various actors in the cybersecurity sector in Euskadi, contributing to the formation of networks that enable the exchange of information, knowledge and talent. The Community is made up of various stakeholders, including companies that can publish information and users registered on the forums and other services.
Through the Community, Cybasque provides users with access to various content, services, information and data (the “Content”) made available to users by Cybasque or third-party service and content providers. Cybasque reserves the right to modify at any time the presentation, configuration and location of the Community, as well as the content and conditions required to use it.
3. ACCESS AND USER STATUS
Access to the website is free and open for the majority of its information, but certain services will only be accessible to those users and organisations that register on the platform.
Registered user status is acquired through the sign-up process, where a company or professional may register as a “Company”. Registered companies may register various users for material participation in the Community, and it is the company’s responsibility to comply with the conditions set out in this legal notice and the rest of the documentation applicable to the use of the Community.
4. INTELLECTUAL AND INDUSTRIAL PROPERTY
All industrial and intellectual property rights in the content and/or any other elements included on the website (including without limitation trademarks, logos, trade names, texts, images, graphics, designs, sounds, databases, software, flow charts, presentation, look-and-feel, audio and video) belong to Cybasque and/or third parties. In no case does access to the Community imply any waiver, transfer, licence or total or partial assignment of such rights, unless expressly stated otherwise. This legal notice does not grant users any other right to use, alter, exploit, reproduce, distribute or publicly communicate the Community and/or its content beyond those expressly provided herein. Any other use or exploitation of any rights will be subject to prior and express authorisation specifically granted for that purpose by Cybasque or the relevant third-party rights holder.
With regard to information submitted by each company, each company is responsible for the information it publishes and warrants that it holds all the intellectual property, industrial and/or image rights necessary for such publication. In any case, the conditions contained in the User Terms and Conditions shall apply.
5. DISCLAIMER OF WARRANTIES AND LIABILITY
Disclaimer of warranties and liability for the operation of the Community. Cybasque does not guarantee the availability and continuity of the operation of the Community or of any other websites with which a link has been established. Likewise, Cybasque shall in no event be liable for any damages and losses that may arise from:
- The unavailability or inaccessibility of the Community or of any other sites with which a link has been established;
- Interruption in the operation of the Community or computer failures, telephone breakdowns, disconnections, delays or blockages caused by deficiencies or overloads in telephone lines, the Internet system or other electronic systems occurring in the course of their operation;
- The unsuitability of the Community for the specific needs of users; and
- Other damages that may be caused by third parties through unauthorised interference beyond Cybasque’s control.
Cybasque adopts various protective measures to protect the Website and the Content against third-party computer attacks. However, Cybasque does not guarantee that unauthorised third parties will not be able to access the type of use the user makes of the Community or the conditions, characteristics and circumstances under which such use takes place. Consequently, Cybasque shall in no event be liable for any damages and losses that may arise from such unauthorised access.
Cybasque shall in no event be liable for the use that users and/or third parties may make of the Community or the content, or for any damages and losses that may arise from such use. Cybasque has no obligation to monitor and does not monitor the use that users make of the Community. In particular, Cybasque does not guarantee that users comply with the conditions that apply, nor that they do so diligently and prudently.
6. PRIVACY AND COOKIE POLICY
The processing of users’ personal data shall be governed by the Privacy Policy available at https://cybergune.eus/en/privacy-policy/. The Community also uses Cookies and users may consult the specific policy on these.
7. PARTIAL INVALIDITY
The declaration of any of these general conditions as null, invalid or ineffective shall not affect the validity or effectiveness of the remaining ones, which shall continue to be binding on the parties. The waiver by either party to require, at any given time, compliance with any of the general conditions stipulated herein shall not imply a general waiver of compliance with any other condition or conditions, nor shall it create an acquired right for the other party.
8. APPLICABLE LAW AND JURISDICTION
This Legal Notice is governed entirely by Spanish law. For the resolution of any dispute that may arise from the use of the platform, the user and the owner of the website submit, with express waiver of any other jurisdiction, to the Courts and Tribunals of Bilbao (BIZKAIA).
