Organic Law 7/2021, dated May 26, constitutes the fundamental regulatory framework for the protection of individuals with regard to the processing of personal data by the competent authorities. Its primary purpose is to ensure that, in the context of the prevention, detection, investigation, and prosecution of criminal offenses, as well as in the enforcement of sanctions and the safeguarding of public safety, the fundamental rights of citizens are respected.
This legislation seeks to harmonize the operational needs of law enforcement and judicial agencies with the requirement for lawful, transparent, and proportionate processing of sensitive information. In this way, it establishes clear obligations for data controllers, including the implementation of rigorous security measures and the appointment of a data protection officer, thereby ensuring a balance between law enforcement effectiveness and the protection of privacy.
